This is a legally binding agreement between SYN Hosting and the paying customer (heretofore referred to as 'Client') for all and any services provided by SYN Hosting and/or its affiliates. By using any of our services and/or affiliates, Client agrees to all of the terms and conditions outlined below.
SYN Hosting takes no responsibility for any damages, injuries and/or losses Client may suffer as a result of using our services either directly or indirectly. Client agrees that SYN Hosting takes no responsibility for the data contained within Clients home directories; however Client assumes full responsibility of said data. SYN Hosting also reserves the right to refuse service to anyone for any reason at any time. This agreement may also be modified at any time without notice.
Your privacy is important to us. SYN Hosting does not share your personal information with any third party and/or affiliate that is not disclosed in advance. Some of the information that we collect for billing and/or tax purposes is your name, address, phone number, email address and internet protocol address. In the event of a subpoena by a recognized court in Canada and/or the United States of America, we may be required by law to disclose your personal information along with the content of your home directories.
Abuse & Prohibited Use
SYN Hosting reserves the right to decide as to what constitutes as abuse and any material not mentioned below is left entirely up to the discretion of the SYN Hosting management and/or staff. Abuse can include, but is not limited to the following offences:
A) Any attempts to compromise a server or network device belonging to SYN Hosting and/or any other company, individual or entity is strictly prohibited. This offence also includes IP range scanning, port scanning and/or vulnerability scanning of any type.
B) Any attempts to launch a Denial of Service attack or disrupt a server or network device belonging to SYN Hosting and/or any other company, individual or entity is strictly prohibited.
C) The sending of unsolicited email, newsgroup postings, chain letters and/or anything else that could be considered SPAM is strictly prohibited. This offence also includes the gathering of email addresses to be used for sending unsolicited email using a third party service.
D) The storage and transmission of material that infringes on any copyright, trademark and/or service mark is strictly prohibited. This offence also includes the storage and transmission of copyrighted movies, television episodes, sporting events, music, games, software, ring tones, phone apps, eBooks and/or audio books.
E) The hosting of material that is considered to be illegal in Canada and the United States of America is strictly prohibited. This includes but is not limited to, child pornography, bestiality, hate speech, harassment, online casinos, scam sites and phishing sites used with the intention of defrauding visitors.
F) The hosting of any software, source code and/or any other material that is illegal or could be used to commit an illegal act is strictly prohibited. This includes but is not limited to; exploit source codes, hacking tutorials, hacking tools, viruses and trojans, bomb making and similar destructive device tutorials.
G) The use of BitTorrent clients, BitTorrent trackers, BitTorrent servers, IRC clients, IRC bouncers and IRC servers is strictly prohibited due to the potential for attracting Denial of Service attacks directed at our network.
H) The use of audio servers, game servers, video conversion software, interactive chat rooms and/or any other software that is required to run continuously in the background is strictly prohibited with our web hosting and semi dedicated plans.
I) The hosting of pornographic material with the intention of selling access and/or paid memberships of any sorts is strictly prohibited with our web hosting and semi dedicated plans. However, adult related material that is deemed "non pornographic" is allowed as long as it complies with federal and/or local law.
J) The abuse of SYN Hosting management and/or staff is strictly prohibited and grounds for termination without warning. Abuse can include making threatening statements, overly aggressive communication and/or anything that can be construed as belligerent behaviour.
Please note that violation(s) could lead to a simple warning, suspension of service and/or termination of Clients accounts without warning. In the event that an illegal act is believed to have been committed, federal and/or local authorities may be notified.
Notifications regarding alleged abuse and/or copyright infringement can be sent to firstname.lastname@example.org for further investigation by our staff. Please note that we do not disclose the results of any action we may or may not have taken for privacy reasons.
SYN Hosting will not activate any service until Client has paid in full and passed our internal fraud screening process. If Client should pay with a PayPal eCheck, payment must clear before service is activated. To cancel and discontinue service with SYN Hosting, Client must give written notice via a trouble ticket at least seven days before renewal date.
In the event that Client is unable to pay upon renewal, Client will be given a seven day grace period. If Client still cannot pay after the grace period, Clients service will be suspended until all invoices are paid in full. Should an overdue account reach thirty days, Clients data may be removed without warning. There are no grace periods with our dedicated servers unless prior arrangements have been made and approved.
SYN Hosting will offer every Client a thirty day money back guarantee on all web hosting, reseller hosting and semi dedicated plans minus any fees associated with the purchase or transfer of a domain and/or private SSL certificate. Should Client take advantage of a free domain and/or private SSL certificate and cancel within the first thirty days, the fees associated with those two offerings will be subtracted from the total refund offered.
Domains and private SSL certificates are non refundable due to policies set forth by third party registrars and certificate issuers.
There are absolutely no refunds and/or exchanges of any type with all dedicated servers due to the significant amount of time and effort put into deploying a new server. Refunds and/or credits will only be issued for billing errors, duplicate orders and honouring our uptime guarantee as outlined below.
SYN Hosting will offer every Client a 99.9% uptime guarantee on all web hosting and semi dedicated plans which amount to no more than 43 minutes per month of unscheduled downtime. Clients with a dedicated server will receive a 99.9% uptime guarantee unless a budget dedicated server has been ordered in which case a 99.8% uptime guarantee will apply.
Unscheduled downtime is calculated based on outage reports from a third party monitoring service called Pingdom using five minute interval checks. Scheduled maintenance by SYN Hosting and/or our network providers does not count towards our uptime guarantee nor do any outages caused by Client negligence and/or malicious Denial of Service attacks outside of our control.
In the event that we do not meet our uptime guarantee, Client must submit a trouble ticket to our Accounts Department to receive credit in the form of an additional free month of web hosting or semi dedicated service and/or further compensation depending on the circumstances of downtime. Clients with a dedicated server will receive a 10% refund per every one hour of unscheduled downtime outside of our uptime guarantee with the maximum refund being 100% of the cost of the dedicated server.
Reseller Hosting Policy
In the event that Clients reseller hosting account becomes suspended due to an overdue invoice, all hosting accounts under reseller may also be suspended until payment has been made in full.
Should the reseller hosting account remain suspended for thirty days with no communication from Client, it will then be considered defunct and all subsequent accounts of reseller will either be offered a copy of their data upon verification or offered service directly under SYN Hosting using our standard rates.
Domain Renewal Policy
SYN Hosting will send Client a renewal notice thirty days, fifteen days and finally seven days before domain is set to expire. Client understands that it is their responsibility to ensure that the email address on file is valid and that payment is received in a timely manner.
In the event that Client does not renew their domain on time, the domain will effectively cease to work and will be held in redemption status for thirty days. After the initial thirty days, the domain may end up in extended redemption status where it can only be reactivated after paying the necessary fee which can be as high as $250 as set forth by our domain registrar.
If the expired domain remains under the extended redemption status without renewal, it may be returned to the general public without notice and possibly no longer available to Client for future use.
Dedicated IP Addresses
Due to the impending IPv4 shortage we are only allocating dedicated IP addresses to those who have an immediate need to run private SSL certificates. Any special uses for a dedicated IP address outside of private SSL certificates will be decided on a case-by-case basis.
Limitations of Technical Support
Client understands that SYN Hosting provides technical support on a best effort basis and that there are certain tasks we are unable to offer any assistance with. Some of these limitations to our technical support include the designing of websites, general programming assistance, modifying and/or creating images, the editing of content on a website and/or any problem believed to be unrelated to our service.
